Who Is Subject to the ELD Rule?

ELD Rule Exceptions per the FMCSA.
As specified in the ELD rule, the following are not required to use ELDs (but carriers may choose to use ELDs even if they are not required):

For Carriers required to us ELDs; Drivers who use paper logs may not use them more than 8 days during any 30-day period. 

Driveaway-towaway drivers (were the vehicle driven is the commodity) or the vehicle being transported is a motor home or a recreation vehicle trailer (at least one set of wheels of the vehicle being transported must be on the surface while being transported)
Drivers of vehicles manufactured before model year 2000.

If you need suggestions on witch ELD to use, send us a message, we have researched & used several ELDs and can get you in touch with a competent services. My fist suggestion is to Do NOT use ELDs offered by cellular companies. Verizon, T-Mobile and AT&T all offer ELDs but none perform great.

So you're sure and ready to get started... Where to start is your question.

You may Choose and I recommend doing the research and fillings yourself. However you may feel uncomfortable with the process and think you need help. All the information you provide to Legalzoom or services is the same as the information you would provide on your own filing. These services can double the cost of the fillings quickly If you believe you are not capable I recommend Evilsizor & Associates as they are professionals in the transportation industry and will ensure you are correct in your filings.

Businesses setup
Research where you want to set up your business, Some states offer different tax incentives than others. Follow the Link to see some suggestions on where to or not to set up your business.
Choose a state in which you want to incorporate your business. Some states have cheaper incorporation fees and simpler processes. Visit the website for the Secretary of State's office and look at its requirements for incorporation.
Business Name
When you decide where you are going to create your cooperation, use the Secretary of State's website search name feature to see if your chosen name is available in the state. Pick a few names just in case.
Filing Status
Determine the type of corporation you will incorporate under.
C corporation (C corp)
S corporation (S corp)
Limited liability company (LLC)
For Motor Carriers, C corp is the normal suggestion.
Fill out and file articles of incorporation with the Secretary of State's office. Normally this is available and can be completed online. You will need to pay the state fee here. Download all documents and receipts. You now have a Cooperation!

FMCSA
Register an Account with the FMCSA - you will have 60 day to complete your filing or you will have to start over and pay again.
Use your Email & Phone number you are going to use for your business. Be prepaid the FMCSA gives public access to all filing and many services will start calling and emailing offering services. Beware and stick to your plan.
You will need to have equipment available to complete your filing

Day 1
File for your DOT number and file you BOC-3. I suggest using Evilsizor & Associates for your BOC-3 filing. This is one of the only things a say is better to have someone file for you. Cost is normally $25-$50.
File your UCR at www.ucr.gov. Now you wait.
Day 14

File and bind your insurance
Day 22

Authority Granted

File IRP
File for IFTA in your state
